Defect for cancelled items that were requested by buyer??

I always go above and beyond to do what I can to make my buyers happy. Right now as of August I am losing TSR status and it is due to the face I have a handful of cancellations that were BUYER REQUESTED. Is this a bug??

I have never ever cancelled an item because an item is out of stock OR sold to another buyer. Due to the custom nature of my product I create everything from scratch for each customer so "out of stock" or "sold to someone else" isn't even a possibiliy.

Every single cancellation I have had are initiated by the buyer because they bought the item by mistake or changed their mind. How should this count negatively towards me??

It's amazing. I do anything and everything to jump through hoops to make my buyers happy here on ebay and now I am getting defects for buyer mistakes and flakiness. So irritating!

When I run a scan on my transactions with defects some of these are transactions where the Buyer did not read my listing and live in NY state where I have to add sales tax but sales tax is based on the buyers shipping address in NY (so I cannot have a set sales tax rate added to my listings as I calculate sales tax when I have my buyers shipping address).

In these situations LEGALLY I am not supposed to send a separate invoice for sales tax as NY state wants it all in one transaction so I refund in full and then send a brand new invoice through paypal with the sales tax included. I then receive payment (with sales tax), mark it as paid and then ship as usual.

Apparently now with ebays new way of handling things I have to choose between getting a defect on ebay or legally following state law. How is this even reasonably fair? If I mark the item as paid and then still ship the item why is this still counting as a cancellation for me?? Ugh..EBAY.
